WELDING INDUSTRY WINS FIRST FEDERAL WELDING FUME TRIAL IN MULTIDISTRICT LITIGATION PROCEEDING
Jury Verdict Marks Another Significant Industry Victory
Cleveland, OH and Washington, DC, June 27, 2006 – John Beisner, attorney for several current and former welding rod manufacturers, today issued the following statement regarding the defense verdict in the Solis case, which was returned today after a three-week trial in the United States District Court, Northern District of Ohio, Eastern Division, in Cleveland, Ohio:
“We are extremely pleased that this Cleveland jury has joined the overwhelming majority of juries around the country that have already heard and rejected similar claims. The defense verdict in this case – the first to be tried in federal court as part of the multidistrict litigation proceeding – confirms, yet again, that these cases are without merit.
“The jury’s finding that the defendants did not distribute a product with a marketing defect confirms what these companies have been saying all along. This is an industry that has always worked to ensure the safety of welders, and is proud of its history of providing appropriate warnings and safety information with its products.
“Today’s verdict is just another indication that plaintiffs’ claims are meritless. In recent months, plaintiffs have dismissed thousands of their cases, acknowledged that 40% of their clients were never diagnosed with any neurological condition, and have otherwise admitted that 70% of the allegedly sick claimants have never sought medical treatment.
“Juries have returned defense verdicts in 11 of the 12 of these types of cases tried and the welding industry will continue to defend itself vigorously against the remaining suits.”
